MEMBERSHIP TERMS AND CONDITIONS
Membership
Membership is not transferrable. All membership fees and schedules are subject to change. Membership of the gym is generally not available to children under the age of 16 years. Sunfit International Limited (“Sunfit”) provides a variety of facilities which may be unavailable during a period of repair and maintenance or special events, programs or private parties, or by Management’s schedule for these events. In order to keep the facility in the best possible condition a portion of the facility may be closed for a temporary time period for repairs and renovations. There will be no extensions or adjustment in dues for this period of closure.
Members Health Warranty
The member warrants and represents that the member or any family member or guest entitled to use the facilities under the terms of membership, has no disability, impairment, or ailment preventing him/her from using the spa facilities and engaging in active or passive exercise, or that will be detrimental or adverse to such person’s health, safety, or physical condition if he/she does so engage or participate. The Member acknowledges and agrees that: 1) Sunfit will rely on the foregoing warranty in issuing the Membership; 2) Sunfit shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition; 3) if any fitness assessment or similar testing is performed by Sunfit, it is solely for the purpose of providing comparative data and is not for diagnostic purposes. 4) Sunfit shall not be subject to any claim, demand, or injury whatsoever on account of Sunfit’s evaluation or interpretation of such fitness assessment. 5) Sunfit shall not be liable for any injury arising out of the member’s disability impairment or ailment preventing him/her from using the spa facilities and engaging in active or passive exercise, or that would be detrimental or adverse to such person’s health, safety or physical condition if he/she does so engage or participate. Each member and guest should be aware of his/her medical history and should consult with a physician prior to engaging in exercise or continuing to exercise if a medical condition develops or appears to be developing.
Dress and Conduct
All members should dress appropriately. This includes the wearing of appropriate exercise wear, shoes and the use of a towel. Sunfit is committed to the health, safety and welfare of each of its members and staff and will not tolerate unreasonable, threatening, obscene, harassing, indecent or illegal behavior. Sunfit may, at its discretion, request members and/or their guests to leave the premises. Sunfit, in addition to its common law rights and remedies, also reserves the right to terminate the membership of any member engaging in unacceptable behavior; no refund will be made in such cases. Members are liable for damages to Sunfit’s property that results from the willful or negligent conduct of a member, a member’s guest or dependent children.
Lost Articles and Damage to Member’s Property
Sunfit is not responsible for lost or stolen articles or damage to articles. All articles are stored at member’s risk and the Club discourages members from bringing valuable articles to the Club.
Consent and release for use of Photographic and Video Images
All members, unless specifically requesting not to do so in writing, authorize Sunfit, its directors, employees, contractors or agents, from time to time, without further notice or permission and without payment of any kind to photograph, videotape, and audiotape them for advertising, promotional or instructional purposes.
Rules and Policies of the Club
All members agree to learn and abide by all the rules and policies set out in the Membership handbook and that may change from time to time. Management has the right to suspend and/or terminate any membership for non-compliance or for behavior inimical to the enjoyment of the facilities by other members and staff for any reason deemed sufficient in the sole discretion of Management.
